These Terms and Conditions ("Terms") govern your use of the SuperBased desktop application and associated services ("Service") operated by Gaja AI Private Limited ("Company", "we", "us", "our"), a company registered in India. By downloading, installing, or using SuperBased, you agree to be bound by these Terms.

SuperBased is a desktop screenshot and AI analysis tool that allows users to capture screenshots, annotate them, extract text, ask AI questions about captured content, record screen interactions, and organize captures in a searchable gallery. The application is available for Windows and macOS.
To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate and complete information during registration and to update it as necessary. You must notify us immediately of any unauthorized use of your account.
The Free plan provides access to core features with usage limits as described on our pricing page. The Free plan is available at no cost and does not require payment information.
The Pro plan is a paid subscription that provides unlimited access to all features. Subscriptions are billed monthly through our payment processor, Paddle. Prices are as listed on our pricing page at the time of purchase and may be subject to applicable taxes.
By subscribing to a paid plan, you authorize us (through Paddle) to charge the applicable subscription fees to your chosen payment method on a recurring basis. Subscriptions automatically renew unless cancelled before the renewal date.

The SuperBased application, including its code, design, logos, trademarks, and documentation, is the intellectual property of Gaja AI Private Limited. These Terms do not grant you any rights to our intellectual property except for a limited, non-exclusive, non-transferable license to use the Service as described herein.
Content you create using SuperBased (screenshots, annotations, recordings) remains your property. We claim no ownership over user-generated content.
SuperBased integrates with third-party AI providers (Anthropic, OpenAI, Google, Azure), payment processors (Paddle), authentication services (Clerk), and other services. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.
When you use AI analysis features, you are responsible for ensuring your use complies with the terms of service of the AI provider whose API keys you have configured.
SuperBased provides a local HTTP API and MCP server for programmatic access. The API is restricted to localhost connections only. You agree to use these interfaces responsibly and in compliance with these Terms. Automated or bulk usage that exceeds reasonable use may be restricted.
Your use of SuperBased is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
AI-generated responses and analysis are provided for informational purposes only and may not be accurate, complete, or suitable for any particular purpose. You are responsible for verifying and validating any AI-generated output before relying on it.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GAJA AI PRIVATE LIMITED, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Gaja AI Private Limited and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
